I was recently involved in an accident where I was hit from behind in traffic. The other guy claimed responsibility and I called his insurance (State Farm) to have them look at it. They came and took pictures. Side note: I had my allstate estimate in the car and the guy took pictures of that too. Was that bad that I let him take pics of my estimate? Would his insurance co. pay it all off, meaning I wouldn’t have to put any money into it like a deductible? If the damages come out to 340.00 State Farm would pay it all off right? Thanks
Whenever you are involved in an accident, you should ONLY deal with YOUR insurance company. Let the insurance companies sort out the details; that’s part of what you are paying them to do for you if you are involved in an accident.
Refer ALL requests for information from the other party or their insurance company to YOUR insurance company. While it’s reasonable to let the other insurance company inspect the vehicle, ONLY do so once YOUR insurance company has given the formal OK to do so. Anything that you say to the other party’s insurance company or anything that you show them WILL be used against you if they can come up with any way to deny liability.
Your insurance policy has language that requires you to do this and if they think that anything that you said or did impacts their rights, they will deny your claim and will not assist you in dealing with the other insurance company.
As long as it was clear rear end accident and the other driver admitted to their insurance that it was their fault instead of making something up like you cut in front of him or something like, you should have no problem working with State Farm. State Farm should pay for the reasonable and necessary costs to repair. And they should be willing to at least try to work with a body shop of your choice as well. Keep in mind if you have an older car and they can find an after market part they have the right to only pay for an after market part rather than a new manufactured one. They should pay the cost to repair in full as long as you’re not trying to get brand new parts for an old vehicle or having them replace a front windshield that was damaged but has nothing to do with the accident.
I don’t think there’s anything necessarily wrong with working with their insurance company. Your policy says you should always report an accident to them and you can still do that and appears you already have since they wrote you an estimate. But you do not have to have your insurance pay you and then go after the other insurance. If you go through directly with the other insurance you shouldn’t be out your deductible. If you go through your insurance, you pay your deductible and then get it back after they get the money from the other insurance company. I would make sure your insurance is aware but tell them you want to close without payment and then work with the other insurance company. If they become difficult to work with then I would go through your company.
