There was an incident happened whereby there was a 4 x 4 vehicle speeding behind me while I was signalling right and about to turn right to my point of destination. Suddenly the scooter who was driving on the bike’s lane speed up and when I’ve already turned right, the scooter bump into the rear end of my car creating some small scratches. The 4 x 4 which did not consider to slow down during my turn just left the seen after the scooter man fall on to the ground resulting into the scooter’s fiber glass to break. I went out to check the scooter man about his condition and call 911. The scooter man himself told me that the 4 x 4 vehicle is about to bump into me that time. The scooter man has been attended to immediately by the ambulance who took him and the scooter which has been towed.
The officer told me that I should merge with the bike lane before turning. However the bike lane that weekend has almost been eaten up by the parked vehicles. While the scooter should not be in the bike lane in the first place. The incident report was to be prepared yet. I don’t know what this incident report will do to me.
The insurance agent responded to my call after 2 days saying that if I will be more comfortable, I can file a claim on the internet for my insurance company in case the scooter man ask for claim.
However, thinking that I am not at fault for the scooter man and his scooter, I should not file a claim. I don’t really need any claim for my car. If I will file for a claim, it will increase my premium. I believe, I should be logical about what really should be done.
Does anybody has any idea on what I should do?

in the state of virginia if anybody hits you in the rear its automatically their fault. Did the police give a ticket to anybody? if so then its generally their fault. If no ticket was given then stick to your guns. It was not your fault. You were careful of the cars/pedestrians in the turning lane while a scooter tried to squeeze by.
If the scooterman decides to file a claim on your policy your carrier will contact you anyways. They will need to get your statement of what happened and possibly inspect your vehicle.
If you do not want to file a claim you don’t have to. If the scooter man wants to, you will be notified.
Even if you do report the loss, your premium would not increase unless your carrier paid out on the claim
First, Since the 4 x 4 was not involved, he is not at fault. You and Me are not the ones who determines fault. That is the task of police and/or insurance companies. Simply notify your insurance company and let them handle everything. Isn’t that why you have insurance ?
