My husband was just in an accident. A man backed up into our car in the city. He got a police report. The man wants to pay us without going through his insurance. We of course need and estimate which we can’t get until Monday. So if he does not want to pay can we still submit a claim?
This just in! The police advised him against the report as they said our insurance would go up (ny) even though it was not our fault. Now what?

Give that info to your insurance company so they can sue “the man” and recoup your claim.

You don’t have to report it to your insurance as long as your car is driveable, just his. Many insurance companies may only take a report on the weekend, but nothing will start to happen until Monday (not the insurance company’s fault if body shops aren’t open and so forth).
