How to file an auto insurance claim when you get hit and its not your fault and you have no insurance?

    Contact the insurance company of the person that hit you. Hopefully you got the name while you were at the accident site. If there are no discrepancys and the other driver is not trying to deny that it was their fault, then his/her insurance company is responsible for the damages. If there is a problem with who is at fault then good luck!! I don’t know where you live but in my state it is illegal to drive without insurance.

    First, an insurance policy is contact between you and your carrier. Most insurance polices have “duty to notify” clause. This is to prevent a delayed claims investigation. You can always contact your carrier and file a claim under your own policy and have your claims adjuster file a claim with the at fault carrier for you.

    If you absolutely do not want to file a claim under your own policy, the drivers exchange or police report should indicate who the at fault insurance carrier is. If it is a big name such as Allstate, Progressive, State Farm etc, you can search for their website and locate the “file a claim” area and it will give you phone numbers to contact to file a claim. If you have an insurance company whose name you do not recognize you can contact the department of finance or insurance for the state you live in. Most states have a “check out your insurance carrier” site where you can put in the name of the carrier and it will link you to a website or provide you with contact number and address.

    You will provide the at fault carrier with the same information you would provide your own. Having a police report with all of the information helps to get the adjusters investigation off to a good start.

    File your claim and hopefully you will get a ticket and a large fine. There is no excuse for not having insurance if you can
    not afford it you can not afford to drive. walk or get bike but grow up and get it.

    Call the liable parties carrier and submit a claim. They’ll do the rest. Then you need to go get you own coverage as the insurance company will report it to the DMV. You may have your license suspended and need to file an SR21/SR22 for a period of years.
