If your car was written off?

My husband had a car accident and was rear ended and caused serious damage to the car. The car was taken to an “ATM authorized” by the dealer. The insurance sent a check for more error than the original amount of a damage of about $ 15,000. A few days later the car was later declared a total loss. But since the parties were ordered and no work has been applied for the test to return from the insurance. The body has place claims sent the check, but if their insurance was asked about it, the place known as self-employed (1) they do not know where the check was sent, and (2) that their computers are (ideally) down and could not be reviewed their records to see if the check was sent.

Now my husband can not another car and is not removed from the responsibility of the lease to the Insurance Co gets back his check and, with the dealer, so that this problem can be solved deal.

What should we do? It sounds as if we were stoned and the process takes too long. The accident occurred a month ago. Any suggestions, ESP from those in the areas of insurance, work would be very grateful!
