Should I not pay to small claims court for the car insurance the full amount?

A car approached behind my car in a parking lot a few weeks ago. It was the fault of the other party completely, but the insurance company told me they are only 50% accept liability due to the mechanization and misinterpretations of some of what I do I said. I want to go to small claims court to resolve this.


1. Do I file against the insurance against the driver (the student), or the most important person in the insurance market (which looks like his father)?
2. Is it possible to win? Is this the kind of thing people go to small claims?
3. Any other advice please contact.

File suit against the vehicle owner and driver. Do not sign anything or accept a partial payment, as this is interpreted to mean that the proposed rule will be accepted.

The driver and owner (s) are jointly and severally liable for damages
